Pay your taxes, or else – it depends

Why is that Tom Daschle can't be Secretary of HHS, but Timmothy Geithner is the new Treasury Secretary? Neither one seems to think they should pay taxes.
So, the man that is the head of the department that includes the tax collecting arm of the US government (IRS) doesn't pay taxes even after he is reminded in writing. He waits until just before his nomination is announced to pay.
I am certainly no fan of Tom Daschle, but he shouldn't he be able to claim the Geithner defense? Shouldn't the President refuse to let Daschle step aside?
